General Conditions of Sale (GCS) of MonBiker
1. Preamble
These General Terms and Conditions of Sale (GTC) apply to all sales concluded on the MonBiker website, operated by DAYA WOOD, on behalf of Mr. Ayoub DAHMANE (hereinafter referred to as "the Seller"), whose head office is located at 14 Place Paul Eychart, 63100 Clermont-Ferrand, France . The purchase of products on our site implies unconditional acceptance of these GTC.
2. Products
MonBiker offers electric bicycles and accessories for electric mobility. The products are described and presented with the greatest possible accuracy. However, errors may occur and the Seller cannot be held responsible if the information displayed presents minor differences with the actual product.
3. Price
Product prices are indicated in euros (€) and include all taxes (TTC). Delivery costs are specified when ordering and may vary depending on the destination. The Seller reserves the right to modify its prices at any time, but the products will be invoiced on the basis of the rates in effect at the time the order is validated.
4. Order
The Customer must verify the accuracy of the information provided before confirming his order. Once the order has been confirmed and payment made, the Customer receives a confirmation by e-mail with a summary of the order. The Seller reserves the right to cancel or refuse an order in the event of a dispute with the Customer or suspicion of fraud.
5. Payment
Payment for purchases is made by credit card or any other means of payment accepted on the site. Transactions are secure and payment data is not stored by MonBiker. The Seller reserves the right to verify the validity of the payment before shipping the order.
6. Delivery
The products are shipped to the address indicated by the Customer when ordering. Delivery times are given as an indication and may vary depending on the carrier. In the event of a delay in delivery, the Customer is invited to contact the Seller for additional information. If a package is damaged or missing, the Customer must report it within 48 hours of receipt.
7. Right of Withdrawal
In accordance with French law, the Customer has a period of 14 days from receipt of the products to exercise his right of withdrawal without having to justify reasons or pay penalties. To exercise this right, the Customer must contact MonBiker at info@monbiker.com . The products must be returned in their original condition and at the Customer's expense.
8. Return and Refund Policy
In addition to the right of withdrawal, MonBiker offers a 30-day return policy. The terms and conditions of return are detailed in our Return Policy section. Returned products will be inspected before issuing a refund or exchange.
9. Guarantees
The products sold benefit from the legal guarantee of conformity and the guarantee against hidden defects, in accordance with articles L.217-4 and following of the Consumer Code and articles 1641 and following of the Civil Code. In the event of a lack of conformity or hidden defect, the Customer must contact MonBiker for return or repair procedures.
10. Liability
The Seller cannot be held responsible for indirect damages resulting from the purchase of products on the site. MonBiker's liability is limited to the amount of the order. In the event of force majeure (e.g. natural disaster, strike), the Seller cannot be held responsible for a delay or non-execution of the order.
11. Protection of Personal Data
The personal data collected is used for order management and customer tracking. In accordance with the General Data Protection Regulation (GDPR), the Customer has the right to access, rectify, and delete their data. To exercise these rights, the Customer can contact MonBiker at info @monbiker.com .
12. Disputes and Mediation
In the event of a dispute, the Customer may submit a complaint to customer service at info@monbiker.com . If no solution is found, the Customer may use a consumer mediator free of charge to attempt to resolve the dispute amicably, in accordance with the provisions of the Consumer Code.
13. Applicable Law and Competent Jurisdiction
These General Terms and Conditions are governed by French law. In the event of a dispute, the courts of Clermont-Ferrand shall have sole jurisdiction, subject to any contrary provision resulting from European Regulation No. 1215/2012.
